Setting up an internal alert system: Feedback and Practical case
As an extension of the numerous developments relating to compliance and application of the rule in French law, the "Sapin 2" law was modified by the Waserman law of March 21, 2022;
These modifications aim to strengthen the protection of whistleblowers within companies with at least 50 employees, under public or private law, and to extend the scope of sanctions.
These provisions came into force on September 1, 2022 and the decree of October 3, 2022 provided the expected clarifications on the internal procedures for collecting and processing alerts.
How to approach the implementation of a compliant, optimized and sustainable alert procedure? With whom, when and how? What do we think of the intervention of the third party referred to in the Decree?
