On the occasion of a survey conducted on December 7th on our LinkedIn page, we asked you about the number of existing legal bases according to the GDPR.

You did well! Out of 281 voters, 76% of you voted "6". This is indeed the correct answer, there are indeed 6 legal bases.

The 6 legal bases provided for by the GDPR are: consent, the performance of a contract (or pre-contractual measures), legal obligation, the protection of vital interests, public interest task and legitimate interest.

As a reminder, processing corresponds to a purpose, and must therefore be based on a legal basis. In cases where several legal bases seem applicable, only one must be selected.

This must be specified to the individuals whose data is collected in order to comply with the information and transparency obligations of Articles 13 and 14 of the GDPR.

The legal basis of the processing has an effect on individuals' rights. For example, for processing based on legitimate interest, the individual has the right to object to all or part of the processing. Conversely, if the processing is based on a legal obligation, the individual cannot object to it.
